Abstract


The current migratory situation, which affects the whole of Europe, requires the preparation of new community rules, also in light of the numbers that have increasingly characterized migratory flows between 2019 and 2021. The New Pact on emigration, prepared by the Commission European Union and approved in October 2020, is a new starting point. The New Pact provides for a more certain procedure (at least apparently) so that before entering the EU territory, identification, health checks, security checks and fingerprinting in the EURODAC database can be carried out. Subsequently, thanks to an integrated and modern system of migration and border management and with the improvement of the EURODAC database, it will be possible to examine the single position in the best possible way, facilitating relocation, improving the monitoring of returns and favoring departure. voluntary and reintegration. On 27 April 2021, in the press release published, the Commission informed that it had adopted the first EU strategy on voluntary returns and reintegration. However, the New Pact still presents important critical issues in the management of migratory crisis situations that can cause the contraction of the rights of migrants in general with serious repercussions on people's freedom due to the expansion of forms of detention and confinement. Furthermore, there are no guarantees on the speed of the procedures in order to avoid the forced detention of people.
